Domestic Violence & Abuse


Domestic violence is defined as any incident of threatening behaviour, violence or abuse (psychological, physical, sexual, financial or emotional) between adults who are or have been intimate partners or family members, regardless of gender or sexuality.

Types of Domestic Violence & Abuse

  • the threat of physical violence
  • actual physical violence
  • sexual violence
  • harassment
  • isolation
  • breaking trust
  • disrespect
  • pressure tactics
  • destructive criticism and other types of verbal abuse

As can be seen domestic violence includes a number of different behaviours and not all are criminal acts. Some forms of emotional abuse are not defined as crimes but this behaviour can have a serious and lasting impact on a person’s health and sense of well-being.

How a Solicitor can Help

Our family team is experienced in offering practical help and support at what we recognise is a very difficult and emotional time.

We will discuss with you the most appropriate type of action. This may be a warning letter or in some cases an injunction may be required. This can seek to prevent any further abuse taking place. An Order can be issued by the Court which can-:

  • remove the abuser from the home
  •  

  • allow you to return to the home
  •  

  • state the abuser must not come within a certain distance of you or the home
  •  

  • state the abuser must not harass, abuse or assault you
  •  

The Order can also contain a power of arrest so that, in appropriate circumstances, a police officer can be authorised to arrest the abuser if there is any breach of the Court Order.
