FAQs

1.         How much will it all cost me?

At your first appointment, we will assess whether you are eligible for Public Funding ( formerly “Legal Aid”).      Once your entitlement to Public Funding has been established, we will be able to provide you with a likely costs estimate.    We will also explain to you how the Statutory Charge applies – public funding is like a loan – if you recover or preserve any money or property you may have to pay your legal costs back.      If you keep or buy a property for yourself from the money or property recovered or preserved you will usually be able to postpone repayment.

If you are not eligible for Public Funding we will discuss with you the most appropriate way for you to meet your costs – usually by setting up a monthly standing order so that they are spread evenly throughout our involvement.

2.         How long will the matter take?

Again, at your first appointment, we will endeavour to provide you with a timescale as to how long it may be before the matter concludes.       For example, a straight forward divorce usually takes between six to eight months.

3.         Who will deal with my case?

From the outset your case will be handled by an experienced fee earner in the Family Department.  We strive to ensure continuity of your case.      Each fee earner is supported by a Secretary who will have knowledge of your file and will be able to assist you in the event that the fee earner is not immediately available (e.g. if he/she is at Court, seeing another client etc).        We will endeavour to keep you appraised of your matter as it progresses.

4.         Will I have to go to Court?

We understand that it is not always possible to reach agreement.     If an application to the Court is necessary, we will discuss this in detail with you and explain the procedure, likely timescale and potential costs involved.        We will explain what is likely to happen at the Court hearing.        More often than not, however, agreement can be reached.
